Terms of Service

1. Agreement to these Terms

These Terms are an agreement between you and Mindcraft Inc., 3 Germay Dr, Unit 4 #2316, Wilmington, DE 19804, USA ("we", "us", "iLinga"), covering your use of the iLinga service at ilinga.com, app.ilinga.com and our API.

By creating an account or using iLinga, you agree to these Terms. If you do not agree to them, do not use the service.

2. What iLinga provides

iLinga is a tool for practising a language by speaking it. It gives you:

  • spoken conversation with AI trainers;
  • corrections and explanations generated from what you said;
  • pronunciation scoring and feedback;
  • vocabulary, grammar and pronunciation practice with scheduled review;
  • progress tracking, reports and practice streaks;
  • usage minutes, which you can buy in packages.

The trainers are AI systems, not people, and what they produce can be wrong. Section 4 says more about this. iLinga is a practice tool, not a course, a qualification or a teacher.

3. Eligibility and accounts

You must be at least 18 years old to create an account or buy minutes. By creating an account you confirm that you are.

You sign in either with a one-time link sent to your email address, or with your Google account. There is no password. That means anyone with access to your email account or your Google account can sign in as you, so keeping those secure is your responsibility.

You agree to give accurate information, to keep your account details up to date, and not to let anyone else use your account. Tell us at [email protected] promptly if you think someone has used your account without permission.

We may keep records of the devices and sign-ins associated with your account for security purposes, as described in the Privacy Policy.

4. AI-generated content

This matters enough to state plainly:

  • Your trainers are AI systems. They are not human teachers, native-speaker tutors or qualified instructors, and no human reviews your conversations as part of normal operation.
  • Their output can be wrong. Corrections, grammar explanations, translations, pronunciation feedback, vocabulary definitions, example sentences and reports are generated automatically. They may be inaccurate, incomplete, outdated, or occasionally confident and wrong.
  • Do not rely on AI output as professional advice. Nothing a trainer says is legal, medical, financial, immigration, academic or other professional advice, whatever the conversation happens to be about.
  • We do not guarantee learning outcomes. We do not promise that you will reach any particular level, pass any exam, or achieve any result, in any period of time. That depends mostly on you.
  • Speech recognition can mis-hear you, particularly with background noise, accents and unusual vocabulary. A pronunciation score is a machine estimate, not an assessment by a phonetician.

Use your judgement. If something a trainer tells you matters, check it.

5. Your conduct

Use iLinga for language practice. Do not:

  • break the law, or use the service to produce or distribute unlawful content;
  • harass, abuse or attempt to harm anyone;
  • attempt to gain unauthorised access to the service, other users' accounts, or any system or network we run;
  • probe, scan, disrupt or overload our systems or those of our providers, or bypass rate limits, authentication or other security or access controls;
  • use bots, scripts or other automation to consume minutes, generate sessions or extract content at scale;
  • resell, sublicense or commercially redistribute the service or its output as your own product;
  • commit fraud, including payment fraud, chargeback abuse, or abuse of promotional offers;
  • misrepresent your identity or your right to use a payment method;
  • attempt to extract our prompts, models or trainer configuration, or to reverse engineer the service except where the law expressly permits it.

6. Minutes and usage

Minutes are usage credits for the iLinga service. They measure how much conversation time your account may consume. They are not money, currency, stored value, a payment instrument, a security or a cryptocurrency; they have no cash value; and they cannot be transferred, sold, exchanged or redeemed for cash.

  • Minute packages are sold in fixed sizes. The number of minutes in each package is shown at the time of purchase.
  • Time spent in a practice session is deducted from your balance, rounded up to the nearest whole minute.
  • Your balance is the total of the minutes credited to your account less the minutes you have used.
  • New accounts may receive a quantity of free minutes. Promotional and free minutes are covered in section 9.
  • Purchased minutes do not currently expire. If we ever introduce an expiry period, we will tell you before it applies to minutes you have already bought.

We may correct your balance where minutes were credited in error, where a purchase was reversed, or where minutes were obtained through abuse or fraud.

7. Pricing and payment

Prices are shown in the application at the time of purchase, and the price displayed to you then is the price that applies to that purchase. We may change prices for future purchases at any time.

Payments are processed by Stripe through its hosted checkout. You enter your card details on Stripe's page, not ours, and your use of Stripe's checkout is also subject to Stripe's own terms. We receive a confirmation and the payment identifiers, not your card number.

Prices are shown exclusive of any taxes unless stated otherwise, and you are responsible for any taxes or charges that apply to your purchase and are not collected at checkout.

Where a promotion code is available it may be entered at checkout. Codes may be limited by time, quantity, eligibility or number of uses, and may be withdrawn.

If a payment fails, no minutes are credited and we will tell you by email so you can try again.

8. Refunds

How to request one. Email [email protected] with the purchase you are asking about. We will consider every request.

How we decide. We assess refund requests individually, in good faith, taking into account how much of the purchase has been used, how long ago it was made, whether the service failed to work as described, and whether the request appears to be an attempt at abuse. We do not offer automatic or unconditional refunds, and buying minutes is not a free trial.

What happens to the minutes. Where a purchase is refunded, we may remove the corresponding minutes from your balance. If our systems have not removed them automatically, that does not mean you are entitled to keep them — we may correct the balance afterwards. We may decline a refund where the minutes have already been consumed.

Abuse. We may refuse refunds, reverse credited minutes, and suspend or close accounts where we identify a pattern of refund or chargeback abuse.

Your statutory rights. Nothing here limits any refund, cancellation or withdrawal right you have under the consumer-protection law that applies to you, and where such a right applies it overrides this section.

9. Promotional and free minutes

Free minutes given to new accounts, and any promotional minutes, are provided at our discretion. They may be subject to their own conditions, may be limited in quantity or time, may be changed or withdrawn, and have no cash value.

We may cancel promotional or free minutes, and suspend or close the accounts involved, where they were obtained through duplicate accounts, misrepresentation, automation or any other abuse of a promotion.

10. Intellectual property

iLinga — the software, the API, the websites, the trainer personalities and their configuration, the curriculum and exercise content, the designs, the wordmark and the name — belongs to us or to our licensors, and is protected by intellectual property law.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use iLinga for your own language practice, for as long as you comply with these Terms. That licence does not give you any right to our source code, models, prompts or content beyond using the product as intended.

Reports, corrections and feedback generated for you are yours to use for your own learning. The underlying software and content that produced them remain ours.

11. Your content

"Your content" means what you supply while using iLinga: what you say in a session, the transcripts produced from it, and any text you type.

Your content stays yours. We do not claim ownership of it.

You grant us a licence to host, store, transcribe, transmit, process and display your content, and to share it with the service providers listed in the Privacy Policy, strictly so that we can operate, secure, support and maintain the service for you — for example, transcribing your speech, generating a trainer reply, scoring your pronunciation and building your progress reports. This licence lasts as long as we hold the content, and ends when the content is deleted.

You confirm that you have the right to supply the content you supply, and that doing so does not break the law or infringe anyone's rights.

12. Privacy

Our Privacy Policy explains what we collect, what happens to your voice, which providers process your information, and how to delete your account. It forms part of your agreement with us, and it is worth reading — particularly the section on voice and AI processing.

13. Service availability

We are actively developing iLinga. We may change, add or remove features, trainers, languages, voices, exercise types and providers, and we may do so without notice.

We do not guarantee that the service will be uninterrupted, timely, error-free or available at any particular moment. It may be unavailable for maintenance, because of a fault, or because a third-party provider we depend on is unavailable.

We may suspend or discontinue the service. If we discontinue it entirely, we will make a reasonable effort to give notice and to deal fairly with unused purchased minutes.

14. Suspension and termination

You may stop using iLinga at any time and delete your account from within the application.

We may suspend or terminate your account, with notice where reasonably possible, if you materially breach these Terms; if we reasonably suspect fraud, payment abuse or promotional abuse; if your use threatens the security, integrity or availability of the service; or if we are required to by law.

Where we terminate an account for abuse or fraud, unused minutes may be forfeited. Where we terminate for another reason, we will deal fairly with unused purchased minutes.

Sections that by their nature should survive termination — including sections 10, 11, 15, 16 and 17 — continue to apply.

15. Disclaimers

iLinga is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the service will meet your requirements, that AI-generated output will be accurate, that speech recognition will correctly hear you, or that defects will be corrected.

Nothing in this section excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud, or any non-excludable rights you have as a consumer.

16. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost opportunities or loss of goodwill, arising out of or connected with your use of iLinga, even if we were told such damages were possible.

To the extent the law allows, our total liability arising out of or connected with these Terms or the service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) fifty United States dollars.

Some jurisdictions do not allow these exclusions or limitations. Where that is the case, they apply only to the extent permitted, and your non-excludable statutory rights are unaffected.

17. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws rules.

You and we agree that the state and federal courts located in Delaware, USA have exclusive jurisdiction over any dispute arising out of or connected with these Terms or the service, and we each consent to their jurisdiction.

If you are a consumer resident in a country whose law gives you the right to bring proceedings in your local courts, or whose mandatory consumer-protection rules would otherwise apply, this section does not take that right away from you.

18. Changes to these Terms

We may update these Terms as the service changes. The current version is always published at https://ilinga.com/terms with its effective date.

If a change materially affects your rights or obligations, we will make a reasonable effort to tell you before it takes effect — for example by email or a notice in the application. Continuing to use iLinga after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the service and delete your account.

19. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us about iLinga, and replace any earlier understanding on the subject.

If a provision is found unenforceable, the rest stays in force and that provision applies to the greatest extent permitted.

Our not enforcing a provision is not a waiver of it.

You may not assign or transfer these Terms without our written consent. We may assign them to an affiliate, or in connection with a merger, acquisition or sale of assets.

21. Effective date

These Terms are effective from 7 August 2026.
